The amount or method of calculating any commission may vary depending on the property, development, developer and terms of the relevant commercial arrangement.
 
Any commission or other payment received by Sixth Storey is generally paid by the developer or seller and does not, unless expressly stated otherwise, form an additional charge payable by the purchaser to Sixth Storey.
 
The existence of a commission arrangement does not mean that a property is suitable for you or that Sixth Storey considers it to be a suitable investment for your individual circumstances.
 
Where we provide information about projected rental income, yields, capital growth or other investment characteristics, you should make your own assessment and obtain independent professional advice before proceeding.
 
You should also consider the fact that Sixth Storey may have a commercial relationship with the developer or seller when evaluating information provided about a property or investment opportunity.

Where a developer handles the sale directly, Sixth Storey's role may be limited to marketing the development, introducing prospective purchasers, arranging enquiries or facilitating communication.

In such circumstances, Sixth Storey may not control:

  • the developer's reservation process;

  • the final sale price;

  • the reservation fee;

  • contract documentation;

  • exchange of contracts;

  • construction;

  • completion;

  • snagging;

  • warranties;

  • after-sales service; or

  • other matters relating to the developer's performance of the sale contract.
     

Those matters will generally be governed by the agreement between the purchaser and the developer or seller.

Nothing in this section affects any obligation Sixth Storey may have to act fairly, transparently and in accordance with applicable consumer protection, property agency and other relevant legislation.

Nothing in these Terms limits any rights you may have against the relevant developer or seller under applicable law.

We recommend that you undertake appropriate due diligence, which may include reviewing:

  • title and ownership information;

  • planning information;

  • development documentation;

  • lease terms;

  • service charge arrangements;

  • management arrangements;

  • warranties;

  • financing arrangements;

  • tax implications;

  • market conditions; and
